Welcome to eu.hurley.com, the official direct-to-consumer channel for the HURLEY brand in Europe and other markets accessible from the Website.
The Website is managed by HURLEY 999, S.L., the entity authorised for the commercial exploitation of the HURLEY brand in the relevant territories.

Velara Brands, S.L. acts as the registered seller and contractual counterparty for purchases made on the Website, and issues the corresponding invoices.

In these Terms, references to "we" or "our" shall be understood as referring to HURLEY 999, S.L. and/or Velara Brands, S.L., depending on the function described in each case.
SCOPE AND ACCEPTANCE
These Terms and Conditions (the "Terms") govern the purchase of products through the Website. They are governed by Spanish law and applicable European consumer protection legislation.
These Terms form part, together with the Legal Notice, the Privacy Policy, the Cookie Policy, the Shipping Policy and the Returns and Exchanges page, of the legal framework of the Website. By placing an order, you expressly accept the Terms in effect at that time.
We recommend reading these Terms before purchasing and saving a copy for your reference.
ELIGIBILITY
To purchase on the Website you must be of legal age and act as a final consumer. Minors require the authorisation of their parents or legal guardians.
Our products are sold exclusively for personal use. Purchasing for resale, distribution or professional use is prohibited. We reserve the right to cancel orders when we detect signs of resale purchasing.
PRODUCTS, AVAILABILITY AND PRICING
5.1 Product information
Each product page shows its characteristics, materials, sizes and price. Images are for reference only; slight colour differences may occur depending on your device.
All products are delivered with their original tags. Please do not remove the tags or seals until you're sure you want to keep them, as they are an integral part of the product and their removal will prevent returns.
5.2 Availability
All products are subject to stock availability. If a product is unavailable after you've placed your order, we'll let you know and refund the amount paid.
5.3 Prices and currency
Prices include VAT and all applicable taxes. They are shown in euros (EUR), except for orders to the United Kingdom (GBP) or Switzerland (CHF). Shipping costs are not included and are calculated at checkout.
Prices may change at any time, but the price applicable to your order will be the one displayed at the time of confirmation.
5.4 Pricing errors
If we detect an obvious pricing error, we reserve the right to decline the order. If payment has already been taken, we will issue a full refund.
ORDERING AND CONTRACT FORMATION
6.1 How to buy
Select your product and size, add it to the cart, enter your shipping and billing details, choose your shipping and payment method, review the summary and confirm your order by clicking the purchase button.
6.2 Contract formation
After you confirm your order, we'll send you an acknowledgement email. This acknowledgement does not constitute acceptance. The contract is formed when we send you the shipment confirmation email.
6.3 Right to decline an order
We reserve the right to decline orders in the following cases:
- Product unavailable. • Billing information incorrect or unverifiable. • Order flagged as suspected fraud. • Signs of resale purchasing. • Obvious pricing error. • Unable to deliver to the address provided. • Force majeure event (section 12).
In all these cases, if payment has already been taken, we will issue a full refund.
6.4 Order verification
We carry out automated and, where appropriate, manual checks to verify the billing address and prevent fraud. If your order is suspended, we'll let you know and you can request a human review through Customer Service.
6.5 Your account
You can create a personal account to make future purchases easier. You are responsible for keeping your login credentials secure. We will not be liable for unauthorised access resulting from your failure to protect your password, unless the access is due to a security flaw on our end.
PAYMENT AND INVOICING
7.1 Payment methods
We accept Visa, Mastercard, American Express (where available), PayPal, Apple Pay, Google Pay and Shop Pay. In certain countries we also accept local methods such as Bizum (Spain), iDEAL (Netherlands), Bancontact (Belgium) or Klarna. The current list is shown at checkout.
7.2 Payment processing
The charge will be made when you confirm your order or, depending on the payment method, when the products are shipped. Card payments are processed through providers that meet industry security standards. We do not store full card details.
If payment cannot be processed, the order will not be accepted and we'll let you know so you can try again.
7.3 Invoicing
Invoices are issued by Velara Brands, S.L. in its capacity as registered seller and are sent to your email address. You can request duplicates through Customer Service.
SHIPPING AND DELIVERY

The maximum delivery period will not exceed 30 calendar days from order confirmation. If you haven't received your order within that period due to our fault, you may give us a reasonable additional period and, if delivery still doesn't take place, cancel the contract and receive a full refund.
The risk of loss or damage passes to you when you or a person you've designated, other than the carrier, takes physical possession of the products.
The information in the Shipping Policy forms an integral part of these Terms.
RETURNS, WITHDRAWAL AND WARRANTY

Below is a summary of your rights:
9.1 Right of withdrawal
You have 14 calendar days from receipt of the products to withdraw from the contract, without giving any reason. Velara Brands, S.L., as Registered Seller, will refund all amounts paid (including standard shipping costs) within 14 days. Withdrawal does not apply to personalised products or sealed products opened after delivery for hygiene reasons.
9.2 Extended voluntary returns
In addition to your legal right, we offer a 30-calendar-day return period from receipt. If the return is requested between day 15 and day 30, the refund will cover the product price only, excluding original shipping costs. This policy does not apply to personalised products and does not limit or replace your legal right of withdrawal.
9.3 Legal warranty
All products are covered by the legal conformity guarantee. Velara Brands, S.L., as Registered Seller, is liable for any lack of conformity that becomes apparent within 3 years of delivery. Defects appearing within the first 2 years are presumed to have existed at the time of delivery, unless proven otherwise. In the event of a lack of conformity, you are entitled to repair, replacement, price reduction or contract termination.
9.4 Defective or non-conforming products
If you receive a defective product or one that doesn't match your order, contact our Customer Service team immediately. If the claim is justified, we'll refund the product price and shipping costs. The return will be free of charge.
The information in the Returns and Exchanges page forms an integral part of these Terms.
COMPLAINTS AND DISPUTE RESOLUTION
You may submit complaints through Customer Service (section 11). We will acknowledge receipt and respond as soon as possible.
You may also use the alternative dispute resolution (ADR) mechanisms available in your country of residence. In Spain, you may contact the Consumer Arbitration Boards or the Consumer Affairs Directorate of your Autonomous Community.

If you detect a safety defect in a product, please report it immediately to safety@hurley-emea.com.
FORCE MAJEURE
We will not be liable for failures due to force majeure: strikes, labour disputes, government actions, legal or health restrictions, terrorism, war, fire, extreme weather, epidemics or telecommunications failures.
If a force majeure event occurs, we'll notify you as soon as possible. If the impossibility continues for more than 30 days, either party may terminate the contract and we will issue a refund.
DATA PROTECTION
The processing of your personal data is governed by our Privacy Policy, and the use of cookies by our Cookie Policy, both accessible from the website footer.
AMENDMENTS
We may amend these Terms at any time. The Terms applicable to your order will be those in effect at the time of confirmation. Changes will not affect orders already confirmed.
GENERAL PROVISIONS
- Assignment: We may assign our rights and obligations to another entity without affecting your rights. • Tolerance: Our failure to enforce any obligation does not constitute a waiver of our rights. • Severability: If any clause is declared null, the remainder will remain in full force. • Language: These Terms are available in Spanish. Versions in other languages are for information only; the Spanish version prevails.
APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law, without prejudice to your right to benefit from the mandatory provisions of the law of your country of residence where they afford you greater protection.
If you are a consumer, disputes will be submitted to the courts of your domicile. Otherwise, to those of the city of Barcelona.
