    3. Scope and acceptance

These Terms and Conditions (the “Terms”) govern the purchase of products through the Website. They are governed by Spanish law and by European consumer protection legislation.

Together with the Legal Notice, the Privacy Policy, the Cookie Policy, the Shipping Policy and the Returns and Exchanges page, they make up the legal framework of the Website. By placing an order, you expressly accept the Terms in force at that time.

We recommend that you read them before buying and keep a copy. We also send you a copy with each order confirmation.

    4. Who can buy

To buy on the Website you must be of legal age and act as a final consumer.

Our products are sold for personal use only. Buying for resale, distribution or professional use is not allowed. We may cancel orders where we detect signs of buying for resale.

    5. Products, availability and prices

5.1 Product information. Each product page shows the product’s features, materials, sizes and price. Images are for guidance only and colours may vary slightly depending on your screen.

All products are delivered with their original tags. Do not remove them until you are sure you want to keep the product: they are part of it and, if you remove them, we will not be able to accept the return.

5.2 Availability. All products are subject to stock availability. If a product sells out after you have placed your order, we will let you know and refund the amount paid.

5.3 Prices and currency. Prices include VAT and all other applicable taxes. They are shown in euros (EUR), except for orders to the United Kingdom (GBP), Switzerland (CHF), Denmark (DKK), Sweden (SEK), Poland (PLN), Czechia (CZK) and Romania (RON). Shipping costs are not included and are calculated at checkout.

Prices may change at any time, but the price shown when you confirm your order will apply.

5.4 Pricing errors. If we detect an obvious pricing error, we may decline the order. If payment has already been taken, we will refund it in full.

    6. Ordering and contract formation

6.1 How to buy. Choose the product and size, add it to the cart, enter your shipping and billing details, choose the shipping and payment method, review the summary and confirm the order with the purchase button. Before confirming, you can review and correct any details from the cart and checkout.

6.2 Contract formation. When you confirm your order, we will send you an acknowledgement email, which does not constitute acceptance of the order. The contract is concluded when we send you the shipping confirmation email. We keep an electronic copy of each contract, which you can access from your account or request from Customer Service. The contract can be concluded in Spanish, English, German or French.

6.3 Declining orders. We may decline an order in the following cases:

    • The product is unavailable.
    • The billing details are incorrect or cannot be verified.
    • Fraud is suspected.
    • There are signs of buying for resale.
    • There is an obvious pricing error.
    • Delivery to the address provided is not possible.
    • A force majeure event occurs (section 13).

In all these cases, if payment has already been taken, we will refund it in full.

6.4 Order verification. We carry out automated and, where appropriate, manual checks to verify the billing address and prevent fraud. If we suspend your order, we will let you know and you can ask for it to be reviewed by a person through Customer Service.

6.5 Your account. You can create a personal account to make your next purchases faster. You are responsible for keeping your login details secure. We will not be liable for unauthorised access caused by failing to protect your password, unless it is due to a security flaw on our side.

    7. Payment and invoicing

7.1 Payment methods. We accept Visa, Mastercard, American Express (where available), PayPal, Apple Pay, Google Pay and Shop Pay. In some countries we also accept local methods such as Bizum (Spain), iDEAL (Netherlands), Bancontact (Belgium) or Klarna. The up-to-date list is always shown at checkout.

7.2 Charging. The charge is made when you confirm the order or, depending on the payment method, when the products are shipped. Payments are processed by providers that meet industry security standards. We do not store your full card details.

If the payment cannot be processed, the order will not be accepted and we will let you know so that you can try again.

7.3 Invoicing. Velara Brands, S.L. issues the invoices as registered seller and sends them to you by email. You can request a duplicate from Customer Service.

    8. Shipping and delivery

The Shipping Policy sets out shipping countries, delivery times, costs, tracking and delivery conditions. That information forms part of these Terms.

The maximum delivery time will not exceed 30 calendar days from order confirmation. If, through our fault, you have not received the order within that period, you may give us a reasonable additional period and, if delivery still does not take place, terminate the contract and receive a full refund.

The risk of loss or damage to the products passes to you when you, or a person you have designated other than the carrier, take physical possession of the products.

    9. Withdrawal, returns and warranty

The Returns and Exchanges page explains in detail how to return a product, the deadlines, conditions and refunds. That information forms part of these Terms. Here is a summary of your rights:

9.1 Right of withdrawal. You have 14 calendar days from receipt of the products to withdraw from the contract without giving any reason. To exercise it, let us know clearly: with the returns form on the Website, by email to customer@hurley-emea.com or with the model form in section 9.5. We will refund all amounts paid, including standard shipping costs, within 14 days of your notice. We may withhold the refund until we receive the products or proof that they have been sent. The refund is made using the same payment method you used. If you withdraw using the form on the Website, we will send you an acknowledgement by email without delay.

The right of withdrawal does not apply to personalised products or to sealed products that have been unsealed after delivery and cannot be returned for hygiene reasons.

9.2 Extended voluntary returns. In addition to your legal right, we give you 30 calendar days from receipt to return the products. If the return is requested between day 15 and day 30, only the product price is refunded, without the original shipping costs. This policy does not apply to personalised products and does not limit or replace your right of withdrawal.

9.3 Legal warranty. All products are covered by the legal guarantee of conformity. Velara Brands, S.L., as registered seller, is liable for any lack of conformity that becomes apparent within 3 years of delivery. Defects appearing within the first 2 years are presumed to have existed at delivery, unless proven otherwise. In the event of a lack of conformity, you may ask for repair, replacement, a price reduction or termination of the contract.

9.4 Defective products or products that do not match your order. If you receive a defective product or one different from what you ordered, contact Customer Service as soon as possible. If the claim is valid, we will refund the product price and shipping costs, and the return will cost you nothing.

9.5 Model withdrawal form. You only need to complete and send it if you wish to withdraw from the contract and do not use the returns form on the Website:

To Velara Brands, S.L., C/ Roger de Lauria 19, 4th floor, 46002 Valencia, Spain, customer@hurley-emea.com:

We will not be liable for failures caused by force majeure: strikes, labour disputes, actions by authorities, legal or health restrictions, terrorism, war, fire, extreme weather, epidemics or telecommunications failures.

If a force majeure event occurs, we will let you know as soon as possible. If the impossibility lasts more than 30 days, either party may terminate the contract and we will refund the amount paid.

    14. Data protection

The processing of your personal data is governed by our Privacy Policy, and the use of cookies by our Cookie Policy.

    15. Amendments

We may amend these Terms at any time. The Terms in force when you confirmed your order will apply to it. Changes do not affect orders already confirmed.

    16. General provisions

    • Assignment. We may assign our rights and obligations to another entity without affecting your rights.
    • Tolerance. Our failure to enforce an obligation does not mean we waive our rights.
    • Severability. If any clause is declared void, the rest will remain valid.
    • Language. These Terms are available in Spanish, English, German and French. In the event of any discrepancy, the Spanish version prevails.

    17. Applicable law and jurisdiction

These Terms are governed by Spanish law, without prejudice to your right to rely on the mandatory provisions of the law of your country of residence where they give you greater protection.

If you are a consumer, disputes will be submitted to the courts of your place of residence. Otherwise, to those of the city of Barcelona.
